1. Acceptance of Terms
By downloading, installing, or using the My Storage List iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and My Storage List. Please read them carefully.
2. Description of Service
My Storage List is an iOS mobile application designed to help users organize and track items stored in physical storage boxes. The App provides:
- Storage box and item management
- AI-powered item recognition using on-device and optional cloud-based processing
- Photo documentation and storage
- QR code generation and scanning
- PDF export for printing labels
- Optional iCloud synchronization across your devices
- Import and export capabilities
- Search and filtering functionality
3. User Requirements
To use the App, you must:
- Have an iOS device running iOS 17.0 or later
- Be at least 13 years of age (or have parental consent if required in your jurisdiction)
- Have an Apple ID to download the App from the App Store
- Comply with all applicable local, state, national, and international laws
- Accept these Terms and our Privacy Policy
You are responsible for ensuring your device meets these requirements and for maintaining your device's security.
4. Account and Data
4.1 No Account Required
The App does not require you to create an account. All data is stored locally on your device and optionally in your personal iCloud account.
4.2 Your Content
You retain all rights to the content you create in the App, including:
- Photos and images
- Descriptions and text
- Organization structures
- Any other content you create
4.3 Content Responsibility
You are solely responsible for ensuring your content:
- Does not violate any laws or regulations
- Does not infringe on intellectual property rights of others
- Does not contain malicious code or viruses
- Complies with Apple's App Store Review Guidelines
- Is appropriate and lawful
4.4 Data Backup
You are responsible for maintaining backups of your data. While the App supports iCloud sync, we recommend:
- Enabling iCloud sync to protect against device loss
- Periodically exporting your data using the export feature
- Keeping photos backed up through iOS Photos or other services
5. License Grant
5.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for personal, non-commercial purposes
- Access features you have purchased (if applicable)
5.2 Restrictions
You may NOT:
- Reverse engineer, decompile, or disassemble the App
- Copy, modify, or create derivative works of the App
- Rent, lease, loan, sell, or redistribute the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the App or its systems
- Use automated systems or bots to access the App
6. Premium Features and Payment
6.1 In-App Purchases
The App offers optional premium features available through a one-time in-app purchase ("Premium Access"). Premium features include:
- Unlimited storage boxes and items
- Advanced AI recognition features
- QR code generation and scanning
- PDF export functionality
- Import and export capabilities
- Priority customer support
6.2 Pricing and Payment
- All purchases are processed through the Apple App Store
- Prices are set in the App Store and may vary by region
- Payment is charged to your Apple ID account
- The premium purchase is a one-time payment with no recurring subscription
- Your purchase is permanent and applies to all devices signed in with the same Apple ID
6.3 Refunds
Refunds are handled exclusively by Apple according to their refund policy. We do not process refunds directly. To request a refund:
6.4 Family Sharing
Premium Access may be eligible for Apple Family Sharing, allowing up to 6 family members to share the purchase. Availability depends on App Store configuration.
7. OpenAI Integration (Optional)
7.1 Your Own API Key
The App allows you to optionally connect your own OpenAI API key for enhanced item recognition. If you choose to use this feature:
- You must have an active OpenAI account
- You are responsible for all charges incurred on your OpenAI account
- Your use of OpenAI's services is governed by OpenAI's Terms of Service
- We do not provide, pay for, or subsidize OpenAI API usage
- You can remove your API key at any time
7.2 API Key Security
- Your API key is encrypted and stored securely in iOS Keychain
- We never have access to your API key
- API requests are made directly from your device to OpenAI
- You are responsible for keeping your API key confidential
8. Intellectual Property
8.1 Our Ownership
The App, including its design, code, features, and "My Storage List" trademark, is owned by us or our licensors. All rights not expressly granted to you are reserved.
8.2 Open Source
The App may include open-source software components. The licenses for these components are available within the App or upon request.
8.3 Feedback
If you provide feedback, suggestions, or ideas about the App, we may use them without any obligation to compensate you.
9. Service Availability
9.1 Offline Functionality
The core features of the App work offline. However, some features require an internet connection:
- iCloud sync (requires internet and iCloud service availability)
- OpenAI enhanced recognition (requires internet and OpenAI service availability)
- In-app purchases (requires connection to App Store)
9.2 Service Interruptions
Online features may be temporarily unavailable due to:
- Apple iCloud service interruptions
- OpenAI API service issues
- Your internet connectivity
- Maintenance and updates
We do not guarantee uninterrupted availability of online features.
9.3 Updates and Changes
We may:
- Update the App to add features, fix bugs, or improve performance
- Modify or discontinue features with reasonable notice
- Require you to update to the latest version to continue using certain features
10. Disclaimers and Warranties
IMPORTANT: Please read this section carefully as it limits our liability.
10.1 "AS IS" Provision
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness
- Uninterrupted or error-free operation
10.2 No Guarantees
We do not guarantee that:
- AI recognition will be 100% accurate
- The App will be free from bugs or errors
- iCloud sync will work perfectly at all times
- QR codes will always scan successfully
- Data will never be lost (despite our best efforts)
- The App will meet all your specific needs
10.3 Your Risk
You use the App at your own risk. We recommend:
- Maintaining regular backups of important data
- Not relying solely on the App for critical inventory needs
- Verifying AI recognition results
- Testing features before relying on them
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:
11.1 Indirect Damages
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Business interruption
- Personal injury or property damage
11.2 Specific Limitations
We are not liable for:
- Data loss due to device failure, user error, or third-party service issues
- Incorrect AI recognition results or item identification errors
- OpenAI API charges or service interruptions
- iCloud sync failures or Apple service issues
- Consequences of incorrect inventory tracking
- Any damages resulting from your use or inability to use the App
11.3 Maximum Liability
Our total liability for all claims related to the App shall not exceed the amount you paid us for the App in the 12 months prior to the claim (typically the one-time purchase price).
11.4 Essential Purpose
You acknowledge that these limitations are reasonable and that you would not use the App without them.
12. Indemnification
You agree to indemnify, defend, and hold harmless My Storage List and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your content stored in the App
- Any negligent or wrongful conduct by you
13. Termination
13.1 Termination by You
You may stop using the App at any time by:
- Uninstalling the App from your device
- Disabling iCloud sync in iOS Settings
- Deleting your data through the App
13.2 Termination by Us
We may terminate or suspend your access to the App if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Required by law or court order
13.3 Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- You must stop using the App
- You should delete the App from your devices
- Your data remains on your device until you delete it
- Premium purchases are non-refundable (subject to Apple's refund policy)
14. Apple-Specific Terms
As the App is distributed through the Apple App Store, the following terms apply:
14.1 Acknowledgment
- These Terms are between you and My Storage List, not Apple
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support for the App
14.2 Support and Maintenance
- We, not Apple, are solely responsible for app support
- Contact us at support@mystoragelist.com for assistance
- Apple has no support obligations
14.3 Warranty
- To the extent the App fails to conform to any warranty, you may notify Apple for a refund
- Apple has no other warranty obligations
- Any claims fall under these Terms, not Apple's responsibility
14.4 Product Claims
- Apple is not responsible for addressing claims related to the App
- This includes product liability, regulatory compliance, or consumer protection claims
14.5 Intellectual Property
- Apple is not responsible for investigating or defending intellectual property infringement claims
14.6 Third-Party Beneficiary
- Apple is a third-party beneficiary of these Terms
- Apple may enforce these Terms against you
14.7 Usage Rules
You must comply with Apple's App Store Terms of Service and Usage Rules.
15. Governing Law and Disputes
15.1 Governing Law
These Terms are governed by the laws of your jurisdiction of residence, without regard to conflict of law principles.
15.2 Dispute Resolution
Before filing any legal claim, you agree to:
- Contact us at legal@mystoragelist.com to attempt to resolve the issue
- Provide a detailed description of the dispute
- Allow 30 days for us to attempt resolution
15.3 Arbitration (US Users)
If you are a US user and we cannot resolve a dispute informally, any claim will be resolved by binding arbitration rather than in court, except that:
- You may assert claims in small claims court if they qualify
- Either party may seek injunctive relief in court for intellectual property infringement
15.4 Class Action Waiver
You agree that disputes will be resolved individually, not as part of a class action or representative proceeding.
16. Changes to Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last Updated" date
- Significant changes will be communicated through the App or App Store update notes
- Continued use after changes constitutes acceptance
- If you don't agree with changes, stop using the App
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
17.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
17.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign these Terms. We may assign our rights and obligations without restriction.
17.5 Export Compliance
The App may be subject to export laws. You agree to comply with all applicable export and import regulations.
17.6 Force Majeure
We are not liable for failures or delays due to circumstances beyond our reasonable control.
